I got into a car accident which caused me to incur a lot of expenses. My insurance is going to send me a reimbursement check but it has not gotten here yet. My apartment manager said they file all evictions on the twentieth of each month. I told her my next pay day isn’t until the 21st. I asked her if she could wait until then she said no. I talked to my insurance and they are planning to mail the check out on Monday which is the 17th; then I have to mail the check to my lean holder because they are going to put the check in my name and my lean holder’s name; about time I get the check back from my lean holder it will be after the twentieth as well. Is there anything I can do to stop my landlord from filing an eviction? Do they have to file an eviction by the twentieth or are they just being insensitive. I have paid my rent every single month; and what happens if they do file an eviction? I live in Muscogee County, Columbus GA.
Insensitive? You are trying to force them to loan you money, you are the insensitive one. How is you decided they would be OK not being paid so that you could buy something else?
Yes, they can file and obviously need to. You can come to court and ask to stay if you pay what you owe, which will be both rent and the eviction costs. They have to agree, but they likely will. This at least gets it recorded on your credit history.
